CONFIDENTIALITY

Rule 1.6 confidentiality of information

(a) A lawyer shall not reveal information relating to representation of a client unless the client gives informed consent, except for disclosures that are impliedly authorized in order to carry out the representation, and except as stated in paragraph (c).

Invasion of privacy is knowingly and without lawful authority: (a) Intercepting, without the consent of the sender or receiver, a message by telephone, telegraph, letter or other means of private communications; or (b) Divulging, without the consent of the sender or receiver, the existence or contents of such message if such person knows that the message was illegally intercepted, or if he illegally learned of the message in the course of employment with the agency transmitting it.

As my practice deals exclusively with the private affaira of individuals and families, I will not transmit private information via the Internet without first receiving a writing from the client which references this policy and then directs me to do so, accepting all responsibility for the loss of privacy inherent in the medium.

I believe this writing, which cannot be an e-mail, is necessary in that the right to privacy in communication is that of the client, who is the only one who is competent to waive it. In short, the right is yours to have our communications private and I will not breach my obligation. I ask you to give this matter serious thought before you do so.
